Australia’s Fair Work Ombudsman Discrimination Results

In #Australia, #The Fair Work Ombudsman has revealed more women complained to them of #workplace #discrimination due to #pregnancy in 2012-13, than employees with #disabilities citing discrimination due to a #physical or #mental disability. Of the complaints made to the agency, 28% were from pregnant women, 21% from people with physical or mental disabilities and 11% from those who felt their #family or# care-giving responsibilities resulted in them being treated differently.

California Revises Laws Concerning Disability Discrimination

“Essential Function” Job Descriptions - are a crucial component of HR compliance, especially useful in the mitigation of risk when it comes to the talent acquisition, management and potential termination of individuals with disabilities.

Essential Job Functions (EJF’s) - are the basic job duties that an employee must be able to perform, with or without an accommodation and according to the ADA, should be included in each and every job description. EJF’s are key in determining if applicants are qualified for a given position, when responding to ADA accommodation compliance issues and for performance management.

Essential Job Functions - have always been important but with the new OFCCP Rules impacting Section 503 of the Rehabilitation Act, specifically the nationwide 7% Utilization Goal for qualified Individuals with disabilities and the increased efforts around self-disclosure, EJF’s are more important than ever.

US Airways Receives Largest Fine ever in Disability-Related Case

#US Airways was just fined $1.2 million by the #Department of Transportation for failing to provide #adequate #wheelchair assistance to passengers with #disabilities in #Philadelphia and #Charlotte, N.C. The fine is one of the largest the agency has ever assessed in a #disability-related case.

Sephora Recalls Kat Von D Lipstick

For all you ladies out there……Have you heard of a lipstick called Celebutard? If so, you won’t hear about it anymore because Sephora, who produced this lipstick shade with tattoo artist Kat Von D, is pulling it off its shelves (in stores and online). Why? Because over 1,100 people signed an online petition calling Sephora to withdraw the product citing the name is offensive to those with disabilities and especially those with developmental disabilities.

Although Sephora apologized and immediately removed this shade of lipstick from the line, Kat Von D appeared to make light of the uproar, supposedly tweeting “At the end of the day, it’s just a f— lipstick,” before deleting the comment. Hmmmm.

DOT Mandates Improved Accessibility

The U.S. Department of Transportation issued new rules Monday mandating airlines improve access to their websites and airport kiosks and make other changes to better accommodate travelers with disabilities. Specifically, what this means is that any airline that markets domestic flights as well as those that fly in and out of U.S. airports will have to make the pages the “core travel information and services” pages on their websites, accessible within two years with full site accessibility within three years. In addition, taking effect in 180 days, is the rule that ticket agents must offer web-based discount fares to customers with disabilities who are unable to access airline websites due to their disability.

In terms of airport kiosks, the new rules stipulate that at least 25 percent of them must be accessible to people with disabilities within ten years.

Why these two topics? Why now? With so many definitions of disability, new regulations impacting issues of Leave for individuals with disabilities and increased concerns from managers about appropriate interaction and management performance, specifically with individuals who have cognitive and psychiatric disabilities, the need for this type of training has increased significantly.

Leave as an Accommodation

Provides guidance on an employer's obligation to provide extended leaves of absence or other accommodations to employees who are on a leave of absence and have a disability protected by the ADA.  Specifically, this session reviews the manner in which the EEOC and courts have evaluated extended leaves of absence and claims of undue hardship so that employers can manage employee leaves in compliance with various federal and state laws. The session includes an explanation of the interaction between the ADA and FMLA, common leave-related issues including job attendance, leave duration, undue hardship, intermittent and indefinite leave, performance evaluations, no fault leave policies, 100% healed policies, job protection, maintenance of benefits and much more.

Managing Cognitive and Psychiatric Disabilities

Provides an understanding of how these types of disabilities may affect a person's awareness, memory, ability to learn, process information, interact with others, communicate and make decisions. Often invisible, these disabilities lack the awareness and understanding of more visible disabilities. This session will review the workplace rights of these individuals, under the ADA, workplace impact, the types of accommodations and auxiliary aids most commonly needed and ways in which employers can effectively engage candidates and employees with these functional limitations and still benefit from their talent.

Led by Jana Burke, Springboard’s ADA Employment Specialist, both sessions are offered as webinars or as in-person training, ranging from 90-minutes to two-hours depending on the manner of delivery.

Mandatory Disability Awareness Training for all Airlines

Like many others, I am in and out of airports every week. So often I see passengers who have disabilities who you can tell are having awful travel experiences, not because of anyone intentionally trying to do harm but because of not being aware of appropriate #etiquette, processes to provide assistance. I am happy to report that this will be changing, at least at one airport, #San Francisco (SFO), where employees will be getting trained throughout the #customers journey from curb-side to security to the gate. In fact, #disability awareness training has been made mandatory for all #airlines and #airline service providers. It is my hope that all #airports will recognize the importance of taking such measures in order to provide an #appropriate experience for #travellers with #disabilities.

TV Characters with Disabilities

Have you noticed an increase in the number of #TV characters with #disabilities? If you have, it’s not your imagination. There are 109 such characters being played on #prime time this year out of almost 800. My concern is that the majority of these roles are being played by individuals who do not have disabilities. Of course, they do call this #acting but wouldn’t it be nice if #SAG, the actors union would insist on the authentic and accurate reflection of the people these characters are portraying?

Starbucks – Braille Gift Cards

Since 2011, #Starbucks has offered a #Braille gift card for a limited time each fall. Why only for a limited time?  I don’t know, but obviously Starbucks didn’t know either so they have just announced the #accessible cards will be available year-round.  I wonder when other #retailers will come to their senses and offer Braille gift cards.

Disney World and Disneyland – Disability Pass

#Disney World and #Disneyland have eliminated the #disability pass that many who have visited one of these theme parks and who have a disability or who have family members with special needs have utilized. Instead, they are replacing it with a form of the #FASTPASS, something what park guests are familiar with.

Earlier this year, a #scandal broke out involving Disney theme parks and guests who have disabilities; tour companies were offering “#handicap #tour #guides for hire”, allowing those willing to pay, a way to immediately skip the lines by taking advantage of a free pass intended for disabled guests and their families.

Currently, park visitors who are unable to wait in line are able to access the FASTPASS lines without waiting for a return time. Keeping in line with their theme park peers, On October 9th Disney will be replace this system with a pass that allows guests to reserve a time to return, similar to the current FASTPASS system but with shorter wait times.

Rehabilitation Act of 1973 – 40th Anniversary

In light of the new 503 regulations in the U.S., I thought folks might like to be reminded of another U.S. regulation, the Rehabilitation Act of 1973, which this Thursday, September 26th, will celebrate its’ 40th anniversary. This federal law created the largest and most comprehensive training and vocational program for people with disabilities. It also prohibits discrimination against qualified individuals with disabilities in employment and in programs that are conducted by federal agencies or entities that receive federal financial assistance.
