Should a man with HIV get a hearing over rejection to join the Atlanta police force?

A 40-year old man was denied a spot on the Atlanta police force because he is HIV positive. Does this fact alone enough to disqualify him from being a police officer? Was requiring a medical exam before a job offer was extended an ADA violation? Is the fact that the City of Atlanta admitted that there are already HIV-positive police officers serving on the force affect what you think? Is there any reason why this would his man be treated any differently? Are there policies & procedures that might result in disqualification?

One more fact: this particular man was working in the taxicab division of the Atlanta Police Department and then applied to be a police officer. I look forward to hearing what you think about this interesting situation.
